{"id":920197,"date":"2026-07-16T02:14:31","date_gmt":"2026-07-16T07:14:31","guid":{"rendered":"https:\/\/newsycanuse.com\/index.php\/2026\/07\/16\/us-supreme-court-upholds-bans-on-transgender-athletes-in-girls-and-womens-sports\/"},"modified":"2026-07-16T02:14:31","modified_gmt":"2026-07-16T07:14:31","slug":"us-supreme-court-upholds-bans-on-transgender-athletes-in-girls-and-womens-sports","status":"publish","type":"post","link":"https:\/\/newsycanuse.com\/index.php\/2026\/07\/16\/us-supreme-court-upholds-bans-on-transgender-athletes-in-girls-and-womens-sports\/","title":{"rendered":"US Supreme Court upholds bans on transgender athletes in girls\u2019 and women\u2019s sports"},"content":{"rendered":"<div id=\"ArticleContent\">\n<p>Delivering another major blow to LGBTQ rights, the <a data-link-type=\"article-inline\" target=\"_blank\" href=\"https:\/\/7news.com.au\/news\/united-states\">United States<\/a> Supreme Court on Tuesday upheld state laws that <a data-link-type=\"article-inline\" target=\"_blank\" href=\"https:\/\/7news.com.au\/news\/president-donald-trump-to-ban-transgender-women-and-girls-from-female-sporting-teams-and-competitions-c-17628316\">ban transgender athletes from participating in girls\u2019 and women\u2019s sports.<\/a><\/p>\n<p>The court, largely divided 6-3, ruled against two transgender students, Becky Pepper-Jackson and Lindsay Hecox, who had challenged restrictive laws in West Virginia and Idaho, respectively.\n<\/p>\n<p>The court in an opinion authored by Justice Brett Kavanaugh concluded that the laws do not violate either the 14th Amendment to the Constitution, which requires that the law apply evenly to everyone, or Title IX of the Education Amendments of 1972, which bars sex discrimination in education.\n<\/p>\n<p><span>Know the news with the 7NEWS app: <a href=\"https:\/\/7news.com.au\/app?utm_source=7NEWS&#038;utm_medium=contextual-link-app&#038;utm_campaign=7news-app\" target=\"_blank\">Download today <svg viewBox=\"0 0 20 14\" width=\"20\" height=\"14\" role=\"img\" aria-label=\"Arrow\"><title>Arrow<\/title><path d=\"M1 7H19M19 7L13 1M19 7L13 13\" stroke=\"currentColor\" stroke-width=\"1.5\" stroke-linecap=\"round\" stroke-linejoin=\"round\" fill=\"none\" \/><\/svg><\/a><\/span><\/p>\n<p>\u201cThe Constitution and Title IX do not require an overhaul of women\u2019s and girls\u2019 sports throughout America,\u201d Kavanaugh wrote.\n<\/p>\n<p>He expressed sympathy for transgender girls and women who desire to play sports, saying \u201ctheir desire to compete warrants respect\u201d and that they should not be \u201costracised or vilified.\u201d<\/p>\n<p>Although the ruling directly concerns only West Virginia and Idaho, it is likely to affect 25 other states with similar bans.\n<\/p>\n<p>It is the latest in a string of defeats for transgender people at the Supreme Court, which has a 6-3 conservative majority.<\/p>\n<figure><picture><source data-ratio=\"4:3\" media=\"(min-width: 0px)\"  ><img decoding=\"async\" src=\"https:\/\/images.7news.com.au\/publication\/C-22510786\/df87e83b6eea04d797e7a74c9261205a7ad70508.jpg?imwidth=650&#038;impolicy=sevennews_v2\" alt=\"The US Supreme Court. Earlier this year, the court ruled in favour of parents who object to California policies aimed at protecting transgender students. And the court in two decisions last year allowed Trump administration policies that bar transgender people from the military and prevent them from including their gender identity on passports.<\/p>\n<p>In an earlier ruling in 2020 that seems to increasingly appear to be an outlier, the court surprisingly ruled that Title VII of the Civil Rights Act of 1964, the federal law prohibiting discrimination in employment, applies to gender identity as well as sexual orientation.\n<\/p>\n<p>Pepper-Jackson, a 16-year-old high school sophomore, has taken puberty-blocking medication and estrogen and competed in girls\u2019 cross-country, shot put and discus.\n<\/p>\n<p>Hecox, a 25-year-old college student, has received testosterone suppression and estrogen treatments. She tried out for the women\u2019s track and cross-country teams in college without success and has since participated in running and club soccer.\n<\/p>\n<p>While transgender rights appeared to have some momentum a decade ago, the pendulum has now swung in the opposite direction.\n<\/p>\n<p>President Donald Trump, a staunch opponent of transgender rights, issued an executive order soon after taking office last year called \u201cKeeping Men Out of Women\u2019s Sports,\u201d and his administration sided with the states in the Supreme Court case.\n<\/p>\n<p>The administration opposes state policies that allow transgender athletes to fully participate in girls\u2019 and women\u2019s sports, filing a lawsuit against California on the issue.\n<\/p>\n<p>The International Olympic Committee announced in March that transgender women could not compete in Olympic female sports categories going forward.\n<\/p>\n<p>The NCAA and the U.S. Olympic &#038; Paralympic Committee had already imposed new restrictions on transgender athletes.\n<\/p>\n<p>The West Virginia law, enacted in 2021, says gender is \u201cbased solely on the individual\u2019s reproductive biology and genetics at birth.\u201d As such, it says, a female is a person \u201cwhose biological sex determined at birth as female.\u201d\n<\/p>\n<p>The Idaho law, passed a year earlier, similarly says that sports \u201cdesignated for females, women, or girls should not be open to students of the male sex.\u201d<\/p>\n<\/div>\n<p> Digital Staff <br \/><a href=\"https:\/\/7news.com.au\/sport\/us-supreme-court-upholds-bans-on-transgender-athletes-in-girls-and-womens-sports-c-22510786\" class=\"button purchase\" rel=\"nofollow noopener\" target=\"_blank\">Read More<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Delivering another major blow to LGBTQ rights, the United States Supreme Court on Tuesday upheld state laws that ban transgender athletes from participating in girls\u2019 and women\u2019s sports.
