The suit concerns a <a href=\"https:\/\/www.state.gov\/announcement-of-a-visa-restriction-policy-targeting-foreign-nationals-who-censor-americans\/\">policy<\/a> that allows restricting visas to foreign officials who \u201cdemand that American tech platforms adopt global content moderation policies.\u201d The CITR is arguing for a preliminary injunction blocking the policy, which the State Department <a href=\"http:\/\/www.theverge.com\/news\/850067\/us-sanctions-thierry-breton-content-moderation-censorship\">already referenced<\/a> when it sanctioned five people who work on online disinformation issues, including the former European official who spearheaded enforcement of its digital services rules. It says allowing the policy to continue will silence people researching topics like content moderation and misinformation online.<\/p>\n<p>The policy in question was <a href=\"http:\/\/www.theverge.com\/news\/675811\/us-immigration-visas-censorship-content-moderation-europe-digital-services-act\">announced in May last year<\/a>, and the State Department <a href=\"http:\/\/www.theverge.com\/news\/850067\/us-sanctions-thierry-breton-content-moderation-censorship\">issued the sanctions<\/a> in December, saying its targets \u201cadvanced censorship crackdowns by foreign states.\u201d The group included the former EU official Thierry Breton and executives from the Center for Countering Digital Hate (CCDH) and Global Disinformation Index (GDI), both of which are members of CITR. CCDH\u2019s CEO, Imran Ahmed, who was a target of the sanctions, is a lawful permanent US resident, according to CITR.<\/p>\n<div>\n<p>\u201cOne of the worst parts about a chilling effect is all of the research that won\u2019t happen\u201d<\/p>\n<\/div>\n<p>The CITR argues the policy harms scholars\u2019 ability to speak and publish freely. In <a href=\"https:\/\/knightcolumbia.org\/documents\/jmu5ov6uwy\">declarations<\/a> <a href=\"https:\/\/knightcolumbia.org\/documents\/gfnmuc6zi2\">to the court<\/a>, researchers described holding back from publicly discussing work they feared could threaten their visa status, or delay publishing certain research ahead of international travel. \u201cOne of the worst parts about a chilling effect is all of the research that won\u2019t happen,\u201d CITR executive director Brandi Geurkink said at a press conference after the hearing.<\/p>\n<p>The government\u2019s defense largely relies on reading the policy in a very narrow manner. Attorney Zack Lindsey argued it targets only the conduct of people who work for foreign governments, so independent researchers have nothing to fear. Carrie DeCell, senior staff attorney at the Knight First Amendment Institute arguing on behalf of CITR, asserted there\u2019s no evidence figures like Ahmed were coordinating with a foreign government. If the policy is being applied outside its supposed criteria, Boasberg asked Lindsey, \u201cdoesn\u2019t that explode your argument?\u201d Lindsey insisted Ahmed <em>wasn\u2019t<\/em> actually targeted under the policy, despite Rubio referencing it in a memo where he advised that Ahmed was deportable \u2014 and argued the details of any particular target don\u2019t undermine the State Department\u2019s larger authority.<\/p>\n<p>Overall, Lindsey left exactly what constitutes working with a foreign government ambiguous \u2014 an ambiguity that, DeCell said, \u201cseems to be part of the point.\u201d The State Department is seeking to preserve an expansive right to restrict visas, regardless of the specifics of a given policy.<\/p>\n<p>The injunction could hinge partially on technical questions like whether the CITR has grounds to sue. But Boasberg questioned another of the government\u2019s major claims: that a court can only decide if a policy is constitutional in the context of a legal challenge for an individual visa holder who\u2019s facing deportation. \u201cNo matter how preposterous a policy that was promulgated, there could be no constitutional challenge?\u201d he asked as a hypothetical.
