Sony Music <\/em>decision. <\/strong><\/h2>\n<p>The presiding judge made that pause official in a recent order, after the publishers and the Elon Musk-owned social platform asked the court to \u201cstay all current deadlines.\u201d<\/p>\n<p>And the stay request didn\u2019t come out of left field. <a href=\"https:\/\/www.digitalmusicnews.com\/2026\/03\/31\/elon-musk-x-supreme-court-music-publishers\/\" data-wpel-link=\"internal\" rel=\"follow\">As we previously broke down<\/a>, the Supreme Court, in unanimously ruling in favor of Cox, found that service providers can be held contributorily liable only if they induced user infringement or tailored their core offerings to enable infringement.<\/p>\n<p>Naturally, the decision\u2019s significance for similar ISP repeat-piracy cases took center stage out of the gate. But the narrow secondary liability definition is already factoring into a number of copyright cases in and beyond the music world.<\/p>\n<p>(One of the non-music cases: Textbook publishers\u2019 copyright and trademark infringement showdown with Google, which promptly moved to stay discovery pending the resolution of a <em>Cox v. Sony<\/em>-related motion for partial judgment.)<\/p>\n<h4><strong>Enter X\u2019s push to toss the remainder of publishers\u2019 infringement claims due to the perceived lack of secondary liability. <\/strong><\/h4>\n<p>It\u2019s against this backdrop, with a dismissal demand looming large, that both sides <a href=\"https:\/\/www.digitalmusicnews.com\/pdf.php?file=concord-v-x-3-23-cv-00606-stay-apr-2026.pdf\" data-wpel-link=\"internal\" rel=\"follow\">requested<\/a> \u201ca stay of all deadlines in the current schedule\u201d so they could \u201cmeet and confer regarding the appropriate next steps for this litigation.\u201d<\/p>\n<p>And with Judge Aleta Trauger having <a href=\"https:\/\/www.digitalmusicnews.com\/pdf.php?file=concord-v-x-3-23-cv-00606-stay-order-apr-2026.pdf\" data-wpel-link=\"internal\" rel=\"follow\">signed off<\/a> on the request, as mentioned, the litigants are expected to submit a joint schedule proposal by next Wednesday, April 8th.<\/p>\n<p>Besides addressing X\u2019s anticipated attempt to end the litigation, said schedule will cover the plaintiffs\u2019 opposition and possible motions to amend the complaint and\/or seek reconsideration of the prior partial dismissal.<\/p>\n<p>On the latter front, it\u2019s been two years and change since the court dismissed vicarious and direct infringement claims against X. And while it\u2019s unclear what the reconsideration request may look like, the \u201cpossible\u201d descriptor is important here; the plaintiffs only indicated that they \u201cmay file\u201d related motions.<\/p>\n<h4>Time will tell where this definitive pause leads the years-running case \u2013 and what\u2019s in store for other infringement disputes impacted by <em>Cox v. Sony<\/em>.<\/h4>\n<p>As noted, different ISP disputes jump out; the major labels\u2019 suit <a href=\"https:\/\/www.digitalmusicnews.com\/2025\/07\/16\/major-labels-altice-lawsuit-stayed\/\" data-wpel-link=\"internal\" rel=\"follow\">against Altice<\/a> was gearing up for a jury trial until being stayed pending the Supreme Court\u2019s determination.<\/p>\n<p>But so do complaints like Epidemic Sound\u2019s nearly four-year-old (<a href=\"https:\/\/www.digitalmusicnews.com\/2025\/12\/04\/epidemic-sound-meta-lawsuit\/\" data-wpel-link=\"internal\" rel=\"follow\">first<\/a>) copyright action against Meta. Last week, the Facebook parent formally moved to invoke <em>Cox v. Sony <\/em>into its summary judgment motion.
