Regulators have shown limited flexibility, even during crises like the Ukraine war, according to legal experts<\/li>\n<\/ul>\n<p>Nestl\u00e9 and Pladis were forced to drop the word \u2018chocolate\u2019 from their white chocolate Kit Kats and Digestives, after cocoa butter levels dipped below the UK\u2019s legal minimum of 20%, as revealed by <a href=\"https:\/\/www.thegrocer.co.uk\/news\/white-chocolate-digestives-and-kit-kats-no-longer-white-chocolate\/706607.article\" target=\"_blank\" rel title=\"https:\/\/www.thegrocer.co.uk\/news\/white-chocolate-digestives-and-kit-kats-no-longer-white-chocolate\/706607.article\">The Grocer<\/a> last month. <\/p>\n<p>The news rattled Kit Kat and Digestives fans, though it came as little surprise to industry insiders who\u2019ve watched cocoa prices climb steadily <a href=\"https:\/\/www.foodnavigator.com\/Article\/2025\/08\/05\/cocoa-causes-of-the-price-hikes\/\" target=\"_blank\" rel title=\"https:\/\/www.foodnavigator.com\/Article\/2025\/08\/05\/cocoa-causes-of-the-price-hikes\/\">amid fluctuating harvest volumes<\/a>. <\/p>\n<p>The cocoa crisis \u2013 driven in part by poor growing conditions and crop disease \u2013 has prompted several savvy ingredients firms to explore alternatives. These aren\u2019t just about replacing cocoa, but also meeting rising demand for vegan, clean-label and sustainable options.<\/p>\n<p>Majors giving attention to alternatives in recent months include Cargill, which last year pumped <a href=\"https:\/\/www.foodnavigator.com\/Article\/2024\/09\/18\/Cargill-spends-big-on-Netherlands-spray-facility-expansion\/\" target=\"_blank\" rel title=\"https:\/\/www.foodnavigator.com\/Article\/2024\/09\/18\/Cargill-spends-big-on-Netherlands-spray-facility-expansion\/\">\u20ac35m into a new chocolate-reducing facility<\/a>. This focus is about tapping into nourishing the world in a \u201c<a href=\"https:\/\/www.foodnavigator.com\/Article\/2024\/11\/25\/cargill-boss-on-investment-innovation-and-expansion\/\" target=\"_blank\" rel title=\"https:\/\/www.foodnavigator.com\/Article\/2024\/11\/25\/cargill-boss-on-investment-innovation-and-expansion\/\">sustainable and responsible way<\/a>\u201d, Cargill EMEA group president for food solutions said last year.<\/p>\n<p>That doesn\u2019t mean the industry is turning its back on cocoa. \u201cWe believe that alternatives to chocolate aren\u2019t about replacing cocoa \u2013 it\u2019s about offering a new, more sustainable choice for people who are looking for something different, whether for curiosity, cost or environmental reasons,&#8221; says Cargill\u2019s chocolate confectionery and ice cream category senior director Anne Mertens-Hoyng. <\/p>\n<p>Providing choice will help to build a more resilient and inclusive food system, she believes. <\/p>\n<h2>Recipes The exploration of cocoa alternatives<\/h2>\n<p>Barry Callebaut echoes the sentiment. \u201cWe see the exploration of alternatives, such as cocoa cell culture technology, not as a replacement for traditional cocoa, but as a way to broaden the spectrum of cocoa-based ingredients available to our customers,\u201d a spokesperson said.<\/p>\n<p>\u201cWe believe many of our customers are increasingly open to innovative and sustainable solutions, especially those that align with evolving consumer expectations.\u201d<\/p>\n<p>Both companies are focused on expanding sustainable cocoa sources while continuing to support traditional cocoa farmers and communities. <\/p>\n<figure>\n<div><picture><source  media=\"(max-width: 768px)\"><source  media=\"(min-width: 769px) and (max-width: 1058px)\"><source  media=\"(min-width: 1059px)\"><img decoding=\"async\" title=\"recipes\" data-chromatic=\"ignore\" alt=\"recipes Innovative ingredients changing chocolate manufacturing and packaging\" src=\"https:\/\/www.foodnavigator.com\/resizer\/v2\/7RAJ6RBFLRDTTCGVWAH2DQPFZU.jpg?auth=7f82144e4b1b554933d90469c6f9a06d43165218b086514e5bb3ff364d5671af&#038;smart=true\" loading=\"lazy\"><\/picture><\/div><figcaption><span>Ingredient innovation is reshaping how chocolate products are made and marketed. (Nastasic\/Image: Getty Images)<\/span><\/figcaption><\/figure>\n<p>But alternatives come with legal strings attached. \u201cDue to the cost increases of some basic commodities such as cocoa, it is of course very appealing to turn to less expensive and less volatile alt ingredients,\u201d explains Katia Merten-Lentz, partner at Food Law Science &#038; Partners. <\/p>\n<p>Recipe changes are rarely simple \u2013 especially at scale \u2013 where taste, texture and appearance all matter. But regulation is the real sticking point. <\/p>\n<p>\u201cReplacements could have legal consequences as well,\u201d Merten-Lentz warns. \u201cFor instance, for organic products which require only organic ingredients in their composition. Or for \u2018chocolate\u2019 based foods which have to comply with the chocolate directive which allows only some alternatives to cocoa butter.\u201d<\/p>\n<h2>Recipes How to use cocoa alternatives<\/h2>\n<p>So, are cocoa alternatives a legal no-go? Not quite. \u201cRespect the mandatory particulars of the Food Information to Consumers Regulation (FIC),\u201d she advises, including updating ingredient lists.<\/p>\n<p>More critically, \u201cif the replaced ingredient was highlighted somewhere on the packaging \u2013 whether in the name, description, or imagery \u2013 that change must be clearly indicated to avoid misleading consumers,\u201c she adds. <\/p>\n<p>Cargill agrees. \u201cNaming and labelling are critical when working with alternative ingredients, especially in sensitive categories like chocolate,\u201d says Mertens-Hoyng.<\/p>\n<figure>\n<div><picture><source  media=\"(max-width: 768px)\"><source  media=\"(min-width: 769px) and (max-width: 1058px)\"><source  media=\"(min-width: 1059px)\"><img decoding=\"async\" title=\"recipes\" data-chromatic=\"ignore\" alt=\"recipes Food industry adapting to cocoa shortages and labelling rules\" src=\"https:\/\/www.foodnavigator.com\/resizer\/v2\/GLQ7GYG3MZDDJP5227D75EFAV4.jpg?auth=84813b581b33b92436c0eb80f69814a846a337d6e619e13e2f281022fbd94f75&#038;smart=true\" loading=\"lazy\"><\/picture><\/div><figcaption><span>Food manufacturers are adapting recipes and labels amid cocoa supply issues.
