Kraken says that the dismissal came with prejudice, meaning the case cannot be refiled and notably includes no admission of wrongdoing, no financial penalties, and no mandated changes to Kraken\u2019s business practices. Kraken joins <\/span><a href=\"https:\/\/fullycrypto.com\/sec-formally-drops-coinbase-securities-case\"><span>the likes of Coinbase<\/span><\/a><span>, Binance, and Robinhood in having investigations or lawsuits dropped as the SEC reprioritises under its new leadership.<\/span><\/p>\n<h2><span>Allegation of Sales of Securities<\/span><\/h2>\n<p><span>The <\/span><a href=\"https:\/\/fullycrypto.com\/kraken-sued-by-sec-over-securities-claims\"><span>SEC initiated legal action against Kraken<\/span><\/a><span> in November 2023, alleging that the exchange had been operating as an unregistered securities exchange, broker, dealer, and clearing agency. The regulator claimed that Kraken\u2019s activities deprived investors of significant protections associated with registered entities.\u00a0<\/span><\/p>\n<p><span>Kraken consistently disputed these allegations, maintaining that its operations were lawful and transparent, and vowed to fight.<\/span><\/p>\n<p><span>The exchange put out a <\/span><a href=\"https:\/\/blog.kraken.com\/news\/sec-lawsuit-dismissal\" target=\"_blank\" rel=\"nofollow noopener\"><span>press release<\/span><\/a><span> Monday titled \u201cA win for fairness,\u201d in which it expressed strong approval of the SEC\u2019s decision to dismiss the lawsuit:<\/span><\/p>\n<blockquote>\n<p><span>The SEC\u2019s decision to dismiss its lawsuit against us (and many others) is more than just a legal victory \u2014 it\u2019s a turning point for the future of crypto in the U.S.<\/span><\/p>\n<\/blockquote>\n<p><span>The post further criticized the previous regulatory approach, asserting that the lawsuit \u201cundermined a nascent industry that repeatedly urged clear rules of the road.\u201d<\/span><\/p>\n<h2><span>The Tide Continues to Change<\/span><\/h2>\n<p><span>The dismissal of the lawsuit against Kraken is part of a broader trend of regulatory shifts under the current U.S. administration.
