A 2023 inquiry concluded that Ashton died due to a<strong> gambling disorder<\/strong>, and evidence revealed he spent whole days gambling with Betfair in the weeks before his death.\u00a0<\/p>\n<h2 id=\"h-the-ukgc-refrained-from-harsh-punishments\"><strong>The UKGC Refrained from Harsh Punishments<\/strong><\/h2>\n<p>The coroner investigating Ashton\u2019s case issued a<strong> Prevention of Future Deaths<\/strong> (PFD) report, warning that there would be more gambling-related deaths if <strong>drastic measures<\/strong> were not taken. The report identified severa<strong>l critical failings<\/strong>, including Betfair\u2019s inadequate player protection tools, the lack of meaningful intervention, and flaws in the company\u2019s risk detection algorithms.<\/p>\n<p>Following the tragic incident, the UKGC reviewed legal findings regarding the case, but in <strong>March 2024<\/strong>, it chose<strong> not to take regulatory action<\/strong> against Betfair. The Commission asserted that its prior intervention of placing Betfair in <a href=\"https:\/\/www.gamblingnews.com\/news\/uk-gambling-firms-reportedly-avoid-publicly-disclosing-breaches\/\">special measures<\/a> from January to <strong>June 2021<\/strong> had already resolved the issues.<\/p>\n<p>However, in 2024, the Commission conceded it had reached this conclusion without <a href=\"https:\/\/www.gamblingnews.com\/news\/coroners-under-fire-by-families-of-gambling-addiction-victims\/\">adequately considering<\/a> the coroner\u2019s report and agreed to <strong>reexamine its position<\/strong>. In November 2024, it again<strong> refused to take action<\/strong>, citing uncertainty over whether Betfair\u2019s special measures were implemented before or after Luke\u2019s gambling and <strong>difficulties <\/strong>in investigating the case due to the passage of time.<\/p>\n<h2 id=\"h-the-lawsuit-alleges-insufficient-regulatory-action\"><strong>The Lawsuit Alleges Insufficient Regulatory Action<\/strong><\/h2>\n<p>Unconvinced by the UKGC\u2019s reasoning, Luke\u2019s widow, <strong>Annie Ashton<\/strong>, is taking the regulator to court. The authority faces accusations of <a href=\"https:\/\/www.gamblingnews.com\/news\/uk-gambling-commission-under-fire-over-failure-to-probe-suicide\/\">failing its duty<\/a> to protect vulnerable individuals under the <strong>Gambling Act 2005<\/strong>.
