{"id":819868,"date":"2025-01-14T11:12:36","date_gmt":"2025-01-14T17:12:36","guid":{"rendered":"https:\/\/newsycanuse.com\/index.php\/2025\/01\/14\/brazil-ministry-of-sports-calls-for-action-against-misleading-youtube-gambling-ads\/"},"modified":"2025-01-14T11:12:36","modified_gmt":"2025-01-14T17:12:36","slug":"brazil-ministry-of-sports-calls-for-action-against-misleading-youtube-gambling-ads","status":"publish","type":"post","link":"https:\/\/newsycanuse.com\/index.php\/2025\/01\/14\/brazil-ministry-of-sports-calls-for-action-against-misleading-youtube-gambling-ads\/","title":{"rendered":"Brazil ministry of sports calls for action against misleading YouTube gambling ads"},"content":{"rendered":"<p><strong>Brazil&#8217;s ministry of sports has requested help from the ministry of justice and public security (MJSP) to shut down misleading gambling ads on YouTube.<\/strong><\/p>\n<div id=\"post-338336\">\n<p>Through the National Secretariat for Sports Betting and Economic Development of Sports (SNAEDE), the ministry of sports on 18 November <a href=\"https:\/\/www.gov.br\/esporte\/pt-br\/noticias-e-conteudos\/esporte\/ministerio-do-esporte-intensifica-medidas-contra-crimes-em-apostas-online\" target=\"_blank\" rel=\"noreferrer noopener\">sent a letter<\/a> to the MJSP calling on them to clamp down on influencer gambling ads after identifying over 53 YouTube accounts promoting gambling with false promises of easy profits in Brazil. <\/p>\n<p>The ministry of sports has called upon the MJSP to intensify its investigations into influencer marketing and involve the federal police to help counter continuing issues.<\/p>\n<p>The channels in question were attracting audiences of over 100,000 viewers a broadcast, capturing the attention of SNAEDE, which was created in July through the signing of Decree 12,110 by President Lula.<\/p>\n<p>In its investigation SNAEDE found that some operators using influencers to promote games are taking bets but fail to pay out on winnings. The sites are then deactivated and the operators disappear with the money.<\/p>\n<h2 id=\"h-previous-cases-of-nefarious-i-nfluencer-marketing-in-brazil\">Previous cases of nefarious i<strong>nfluencer marketing in Brazil<\/strong><\/h2>\n<p>The case is somewhat similar to that of Fortune Tiger, an Asian-themed slot which has been heavily <a href=\"https:\/\/igamingbusiness.com\/legal-compliance\/regulation\/brazil-social-media-black-market\/\" target=\"_blank\" rel=\"noreferrer noopener\">scrutinised in Brazil<\/a> particularly for its links to influencer advertising, although there\u2019s no evidence that the game\u2019s creator PG Soft is at fault for how it is being marketed.<\/p>\n<p>Investigations in the Brazilian states of Paran\u00e1 and Maranh\u00e3o led to a number of influencers being arrested for promoting attractive financial rewards from Fortune Tiger to their followers, many of whom lost large sums of money due to fraudulent operator sites.<\/p>\n<p>The Brazilian government has since taken steps to restrict influencer advertising via its gambling marketing regulations, released on 31 July.  <\/p>\n<p><a href=\"https:\/\/igamingbusiness.com\/legal-compliance\/online-gaming-brazil-ordinances\/\" target=\"_blank\" rel=\"noreferrer noopener\">Normative Ordinance No 1,207<\/a> restricts operators from presenting gambling as a \u201csocially attractive\u201d activity through influencer or celebrity marketing. <\/p>\n<p>Udo Seckelmann, head of gambling &#038; crypto at Bichara e Motto Advogagos, said at the time those <a href=\"https:\/\/igamingbusiness.com\/legal-compliance\/regulation\/brazil-ordinances-legal-market\/\" target=\"_blank\" rel=\"noreferrer noopener\">regulations would aid channelisation<\/a> towards safe and legal betting.<\/p>\n<p>\u201cThe problems and issues regarding Fortune Tiger were never due to the game itself, but rather  how advertising by influencers was being [carried out],\u201d <a href=\"https:\/\/igamingbusiness.com\/legal-compliance\/regulation\/brazil-ordinances-legal-market\/\" target=\"_blank\" rel=\"noreferrer noopener\">Seckelman explained to iGB<\/a>. \u201cNow that we have the Responsible Gambling and Advertising Ordinance, these issues will be considerably reduced.\u201d<\/p>\n<h2 id=\"h-ministers-call-for-better-fraud-prevention\">Ministers call for better fraud prevention <\/h2>\n<p>SNAEDE has warned against the promotion of gambling ads by influencers misleading Brazilians into believing they can achieve quick and easy profits from betting. It calls for better fraud prevention in gambling marketing. <\/p>\n<p>Secretary Giovanni Rocco, elected to the role in September, said: \u201cThe sites hide behind social media platforms to carry out scams.<\/p>\n<p>\u201cThey deceive people through influencers, promising quick gains and money to pay bills, go to the grocery store, supplement their income. But this is not gambling; it is a crime against the popular economy.\u201d<\/p>\n<p>Sports minister Andr\u00e9 Fufuca added: \u201cWe are talking about thousands of Brazilians who, deceived by promises of easy money, end up being victims of fraud.<\/p>\n<p>\u201cSports betting must be regulated to guarantee transparency and security for the population. Our priority is to protect Brazilians and ensure the integrity of sports.\u201d<\/p>\n<h2 id=\"h-further-advertising-restrictions-in-the-works\"><strong>Further advertising restrictions in the works<\/strong><\/h2>\n<p>Earlier this week, Brazil\u2019s National Consumer Secretariat (Senacon) <a href=\"https:\/\/igamingbusiness.com\/marketing-affiliates\/marketing-regulation\/brazil-ban-marketing-bonuses\/\" target=\"_blank\" rel=\"noreferrer noopener\">called for all marketing<\/a> including gambling bonuses to be banned alongside betting ads targeting minors.<\/p>\n<p>Senacon issued a preliminary order in the hopes the measures will be introduced as urgently as possible.<\/p>\n<p>Following a <a href=\"https:\/\/igamingbusiness.com\/legal-compliance\/brazil-industry-betting-law-unconstitutional\/\" target=\"_blank\" rel=\"noreferrer noopener\">two-day hearing<\/a> at the Federal Supreme Court (STF) last week, Minister Luis Fux <a href=\"https:\/\/igamingbusiness.com\/casino\/brazil-minister-bans-betting-social-welfare\/\" target=\"_blank\" rel=\"noreferrer noopener\">introduced emergency measures<\/a> to ban betting using social welfare.<\/p>\n<p>Those rules were meant to come in from the legal market go-live date of 1 January 2025.
