{"id":629074,"date":"2023-04-13T13:48:00","date_gmt":"2023-04-13T18:48:00","guid":{"rendered":"https:\/\/news.sellorbuyhomefast.com\/index.php\/2023\/04\/13\/report-trump-in-his-second-deposition-with-the-ny-attorney-general-is-f-ked-either-way\/"},"modified":"2023-04-13T13:48:00","modified_gmt":"2023-04-13T18:48:00","slug":"report-trump-in-his-second-deposition-with-the-ny-attorney-general-is-f-ked-either-way","status":"publish","type":"post","link":"https:\/\/newsycanuse.com\/index.php\/2023\/04\/13\/report-trump-in-his-second-deposition-with-the-ny-attorney-general-is-f-ked-either-way\/","title":{"rendered":"Report: Trump, in His Second Deposition With the NY Attorney General, Is F&#8211;ked Either Way"},"content":{"rendered":"<div>\n<p>Approximately one week ago, <strong>Donald Trump<\/strong> flew to New York to <a href=\"https:\/\/www.vanityfair.com\/news\/2023\/04\/donald-trump-surrenders\" target=\"_blank\" rel=\"noopener\">surrender<\/a> and be <a href=\"https:\/\/www.vanityfair.com\/news\/2023\/04\/donald-trump-hush-money-arraignment\" target=\"_blank\" rel=\"noopener\">formally charged<\/a> by the Manhattan district attorney\u2019s office with 34 counts of falsifying business records in the first degree, crimes that he could, theoretically, <a href=\"https:\/\/www.vanityfair.com\/news\/2023\/04\/donald-trump-possible-prison-sentence\" target=\"_blank\" rel=\"noopener\">go to jail for 136 years over<\/a>. (In reality and assuming he\u2019s found guilty, the sentence would likely be far less than that, but nobody tell <strong>Melania,<\/strong> <a href=\"https:\/\/www.vanityfair.com\/news\/2023\/04\/melania-trump-donald-trump-arraignment-speech\" target=\"_blank\" rel=\"noopener\">who appears to be banking on the full 1,632 months<\/a>.) Anyway, Trump is now back in New York and the circumstances\u2026are not much better!<\/p>\n<p>On Thursday, the ex-president will be <a href=\"https:\/\/www.nytimes.com\/2023\/04\/13\/nyregion\/trump-letitia-james-deposition.html\" target=\"_blank\" rel=\"noopener\">deposed<\/a> under oath for the second time by the office of New York attorney general <strong>Letitia James.<\/strong> Trump was deposed by James\u2019s team for the first time last August, after which the AG filed a $250 million lawsuit against Trump, his three eldest children, and the family business, alleging more than a decade of <a href=\"https:\/\/www.vanityfair.com\/news\/2022\/09\/donald-trump-ivanka-trump-eric-trump-donald-trump-jr-ny-ag-fraud-lawsuit\" target=\"_blank\" rel=\"noopener\">\u201cstaggering\u201d fraud<\/a> that allowed the family to rake in hundreds of millions in ill-gotten gains. (The scheme, according to James, relied on overvaluing Trump\u2019s assets by billions of dollars.) In half a dozen posts beginning early Thursday morning, Trump <a data-offer-url=\"https:\/\/truthsocial.com\/@realDonaldTrump\" href=\"https:\/\/truthsocial.com\/@realDonaldTrump\" rel=\"nofollow noopener\" target=\"_blank\">ranted<\/a> about the case on Truth Social, calling it \u201cridiculous\u201d and \u201canother unjust &#038; ridiculous persecution of The 45th President of the United States\u201d and claiming \u201cNEW YORK STATE SHOULD BE ASHAMED OF THIS INJUSTICE!\u201d He also viciously attacked James, calling her a \u201cracist\u201d and a \u201cLOWLIFE.\u201d In an unintentionally hilarious turn, he claimed that Thursday\u2019s proceedings will allow him to \u201cfinally be able to show what a great, profitable, and valuable company I built, actually, some of the greatest real estate assets anywhere in the world.\u201d<\/p>\n<p>Unlike his first round of questioning with James\u2019s office, in which Trump invoked his Fifth Amendment rights over 400 times, the ex-president is expected to provide actual answers today. And while invoking the Fifth could hurt him at trial, as <em>The New York Times<\/em> <a href=\"https:\/\/www.nytimes.com\/2023\/04\/13\/nyregion\/trump-letitia-james-deposition.html\" target=\"_blank\" rel=\"noopener\">notes<\/a>, he may be f&#8211;ked either way:<\/p>\n<blockquote>\n<div>\n<p>While jurors in criminal trials cannot hold a defendant\u2019s silence against him, in civil trials, they are permitted to take into account a refusal to answer questions\u2014and infer that it means that the defendant had something to hide. If Mr. Trump refused to answer questions, it could seriously damage his chance of winning at trial.<\/p>\n<p>But answering questions on Thursday could expose Mr. Trump to additional legal peril. Once he provides answers on a topic, he would essentially forfeit his right to refuse other questions on that same topic. And it can be easier to refuse to answer substantive questions altogether, than to respond to some while dodging others. The greatest risk to Mr. Trump would come if he went off script. Although he is no stranger to being deposed, there is a chance he could respond impulsively under intense questioning, as he has done in the past, actively confronting his interviewers. (He once told a lawyer that her questions were \u201cvery stupid.\u201d)<\/p>\n<\/div>\n<\/blockquote>\n<p>In addition to potentially using what Trump says on Thursday against him, James, the <em>Times<\/em> writes, \u201ccould eventually share his statements with criminal prosecutors who are also investigating him.\u201d Last December, the Trump Organization was <a href=\"https:\/\/www.vanityfair.com\/news\/2022\/12\/trump-organization-donald-trump-allen-weisselberg-tax-fraud-guilty\" target=\"_blank\" rel=\"noopener\">found guilty of 17 different crimes<\/a>, including tax fraud, conspiracy, and falsifying business records.\u00a0The company\u2019s longtime CFO, <strong>Allen Weisselberg,<\/strong> pleaded guilty and sentenced to five months in prison.<\/p>\n<p>Trump has denied all wrongdoing in the civil suit brought by James.<\/p>\n<p>Of course, the attorney general\u2019s lawsuit is far from the only legal issue facing Trump, who is also <a href=\"https:\/\/www.vanityfair.com\/news\/2023\/04\/donald-trump-fulton-county-possible-indictment\" target=\"_blank\" rel=\"noopener\">under criminal investigation by the Fulton County district attorney<\/a> for his attempt to overturn the 2020 election in Georgia; by the Justice Department for his handling of classified documents (<a href=\"https:\/\/www.vanityfair.com\/news\/2023\/04\/donald-trump-classified-documents-possible-obstruction-of-justice\" target=\"_blank\" rel=\"noopener\">and potential obstruction<\/a>); and by the DOJ for his attempt to overturn the election and the insurrection that followed.
