Witherspoon did the paperwork, according to <a href=\"https:\/\/people.com\/movies\/reese-witherspoon-files-divorce-jim-toth-has-prenup\/\" target=\"_blank\" rel=\"noopener\"><em>People<\/em><\/a><em>,<\/em> in the Circuit Court of Davidson County near their home in Nashville. The actor and producer cited \u201cirreconcilable differences.\u201d<\/p>\n<p>Witherspoon asked that they share custody of son Tennessee James, who\u2019s 10, per the filing. The document also says the couple has a prenuptial agreement.\u00a0<\/p>\n<p>Witherspoon and Toth were married in March 2011 at her ranch in Ojai, California. They would have celebrated their 12th wedding anniversary the weekend following <a href=\"https:\/\/www.glamour.com\/story\/reese-witherspoon-jim-toth-divorce-details\" target=\"_blank\" rel=\"noopener\">their divorce announcement<\/a>. Their message, posted on Witherspoon\u2019s Instagram, read, \u201cWe have some personal news to share\u2026 It is with a great deal of care and consideration that we have made the difficult decision to divorce. We have enjoyed so many wonderful years together and are moving forward with deep love, kindness, and mutual respect for everything we have created together.\u201d<\/p>\n<p>\u201cOur biggest priority is our son and our entire family as we navigate this next chapter,\u201d they added. \u201cThese matters are never easy and are extremely personal.
