{"id":624298,"date":"2023-04-01T09:49:35","date_gmt":"2023-04-01T14:49:35","guid":{"rendered":"https:\/\/news.sellorbuyhomefast.com\/index.php\/2023\/04\/01\/openai-geoblocks-chatgpt-in-italy\/"},"modified":"2023-04-01T09:49:35","modified_gmt":"2023-04-01T14:49:35","slug":"openai-geoblocks-chatgpt-in-italy","status":"publish","type":"post","link":"https:\/\/newsycanuse.com\/index.php\/2023\/04\/01\/openai-geoblocks-chatgpt-in-italy\/","title":{"rendered":"OpenAI geoblocks ChatGPT in Italy"},"content":{"rendered":"<div>\n<p id=\"speakable-summary\">No, it\u2019s not an April Fools\u2019 joke: OpenAI has started geoblocking access to its generative AI chatbot, ChatGPT, in Italy.<\/p>\n<p>The move follows an <a href=\"https:\/\/techcrunch.com\/2023\/03\/31\/chatgpt-blocked-italy\/\">order by the local data protection authority Friday<\/a> that it must stop processing Italians\u2019 data for the ChatGPT service.<\/p>\n<p>In a statement which appears online to users with an Italian IP address who try to access ChatGPT, OpenAI writes that it \u201cregrets\u201d to inform users that it has disabled access to users in Italy \u2014 at the \u201crequest\u201d of the data protection authority \u2014 which it known as the <em>Garante<\/em>.<\/p>\n<p>It also says it will issue refunds to all users in Italy who bought the ChatGPT Plus subscription service last month \u2014 and notes too that is \u201ctemporarily pausing\u201d subscription renewals there in order that users won\u2019t be charged while the service is suspended.<\/p>\n<p>OpenAI appears to be applying a simple geoblock at this point \u2014 which means that using a VPN to switch to a non-Italian IP address offers a simple workaround for the block. Although if a ChatGPT account was originally registered in Italy it may no longer be accessible and users wanting to circumvent the block may have to create a new account using a non-Italian IP address.<\/p>\n<div id=\"attachment_2522637\">\n<p><img loading=\"lazy\" aria-describedby=\"caption-attachment-2522637\" decoding=\"async\" src=\"https:\/\/techcrunch.com\/wp-content\/uploads\/2023\/04\/Screenshot-2023-04-01-at-11.09.34.png?w=424\" alt=\"OpenAI notice to users in Italian about blocking ChatGPT\" width=\"424\" height=\"680\"  ><\/p>\n<p id=\"caption-attachment-2522637\">OpenAI\u2019s statement to users trying to access ChatGPT from an Italian IP address (Screengrab: Natasha Lomas\/TechCrunch)<\/p>\n<\/div>\n<p>On <a href=\"https:\/\/techcrunch.com\/2023\/03\/31\/chatgpt-blocked-italy\/\">Friday<\/a> the <em>Garante<\/em> announced it has opened an investigation into ChatGPT over suspected breaches of the European Union\u2019s General Data Protection Regulation (GDPR) \u2014 saying it\u2019s concerned OpenAI has unlawfully processed Italians\u2019 data.<\/p>\n<p>OpenAI does not appear to have informed anyone whose online data it found and used to train the technology, such as by scraping information from Internet forums. Nor has it been entirely open about the data it\u2019s processing \u2014 certainly not for the latest iteration of its model, GPT-4. And while training data it used may have been public (in the sense of being posted online) the GDPR still contains transparency principles \u2014 suggesting both users and people whose data it scraped should have been informed.<\/p>\n<p>In its <a href=\"https:\/\/www.gpdp.it\/web\/guest\/home\/docweb\/-\/docweb-display\/docweb\/9870847\" target=\"_blank\" rel=\"noopener\">statement<\/a> yesterday the <em>Garante<\/em> also pointed to the lack of any system to prevent minors from accessing the tech, raising a child safety flag \u2014 noting that there\u2019s no age verification feature to prevent inappropriate access, for example.<\/p>\n<p>Additionally, the regulator has raised concerns over the accuracy of the information the chatbot provides.<\/p>\n<p>ChatGPT and other generative AI chatbots are known to sometimes produce erroneous information about named individuals \u2014 a flaw AI makers refer to as \u201challucinating\u201d. This looks problematic in the EU since the GDPR provides individuals with a suite of rights over their information \u2014 including a right to rectification of erroneous information. And, currently, it\u2019s not clear OpenAI has a system in place where users can ask the chatbot to stop lying about them.<\/p>\n<p>The San Francisco-based company has still not responded to our request for comment on the <em>Garante\u2019s<\/em> investigation. But in its public statement to geoblocked users in Italy it claims: \u201cWe are committed to protecting people\u2019s privacy and we believe we offer ChatGPT in compliance with GDPR and other privacy laws.\u201d<\/p>\n<p>\u201cWe will engage with the <em>Garante<\/em> with the goal of restoring your access as soon as possible,\u201d it also writes, adding: \u201cMany of you have told us that you find ChatGPT helpful for everyday tasks, and we look forward to making it available again soon.\u201d<\/p>\n<p>Despite striking an upbeat note towards the end of the statement it\u2019s not clear how OpenAI can address the compliance issues raised by the <em>Garante \u2014<\/em> given the wide scope of GDPR concerns it\u2019s laid out as it kicks off a deeper investigation.<\/p>\n<p>The pan-EU regulation calls for data protection by design and default \u2014 meaning privacy-centric processes and principles are supposed to be embedded into a system that processes people\u2019s data from the start. Aka, the opposite approach to grabbing data and asking forgiveness later.<\/p>\n<p>Penalties for confirmed breaches of the GDPR, meanwhile, can scale up to 4% of a data processor\u2019s annual global turnover (or \u20ac20M, whichever is greater).<\/p>\n<p>Additionally, since OpenAI has no main establishment in the EU, any of the bloc\u2019s data protection authorities are empowered to regulate ChatGPT \u2014 which means all other EU member countries\u2019 authorities could choose to step in and investigate \u2014 and issue fines for any breaches they find (in relatively short order, as each would be acting only in their own patch).
