otherwise, Lendlease would have posted an operating profit of A$105m.<\/span><\/p>\n<p><span>Developers operating in the UK have until 13 March to sign a long-form contract committing to remediate residential building safety risks or face significant trade restrictions.<\/span><\/p>\n<p><span>\u201cThis action has retrospective effect by extending the period for defects liability from six years to 30 years and applying changes to building-safety regulations for completed UK residential buildings,\u201d Lendlease noted in its announcement yesterday.<\/span><\/p>\n<p><span>It warned that the proposed restrictions, including not being able to access government funding or obtain construction approvals, would \u201cmaterially adversely impact [the] operations of Lendlease in the UK\u201d.<\/span><\/p>\n<p><span>The developer is involved in several high-profile UK plans, such as the proposed \u00a33.5bn<\/span><a href=\"https:\/\/www.constructionnews.co.uk\/contractors\/lendlease\/lendlease-jv-submits-new-plans-for-3-5bn-silvertown-development-17-01-2023\/\"> <span>Royal Docks<\/span><\/a><span> development and \u00a38bn<\/span><a href=\"https:\/\/www.constructionnews.co.uk\/consultants\/arup-team-wins-masterplanning-on-8bn-thamesmead-scheme-04-05-2021\/\"> <span>Thamesmead Waterfront<\/span><\/a><span> project in London, and the \u00a31.9bn<\/span><a href=\"https:\/\/www.constructionnews.co.uk\/contractors\/lendlease\/lendleases-1-5bn-birmingham-deal-set-for-approval-09-12-2020\/\"> <span>Smithfield<\/span><\/a><span> scheme (pictured) in Birmingham.<\/span><\/p>\n<p><span>The A$200m provision primarily relates to 56 buildings developed by Crosby Homes, which was acquired by Lendlease in 2005 for \u00a3261m.<\/span><\/p>\n<p><span>Lendlease stated that it no longer owns these properties, many of which \u201cwere completed or construction commenced prior to Lendlease\u2019s acquisition\u201d.<\/span><\/p>\n<p><span>The developer expects that \u201cany cash expenditure by Lendlease will be paid over a period of at least five years\u201d without affecting core operating profit or \u201ctarget metrics\u201d.<\/span><\/p>\n<p><span>Lendlease insisted that each building completed by one of its entities \u201cwas certified as complying with applicable building regulations at the time of its completion\u201d, and no \u201cspecific claims\u201d have been made to date against the company.<\/span><\/p>\n<p><span>The government has provided a schedule of claims it has received for some of the buildings in the Crosby portfolio \u201cand, in some cases, their assessment or estimate of the cost to remediate\u201d.<\/span><\/p>\n<p><span>Lendlease is evaluating this information and extrapolated the data to apply across the rest of its former Crosby portfolio to provide the A$200m estimate.<\/span><\/p>\n<p><span>\u201cDetermining the liability position for this matter and any estimate is a complex process requiring significant judgement with respect to whether there is an obligating event and the quantum of any liability,\u201d Lendlease noted.<\/span><\/p>\n<p><span>\u201cThe estimate of any potential liability is based on incomplete information, given there have been, and continue to be, ongoing discussions with a changing government leadership and limited information as to what is required to be remediated.\u201d<\/span><\/p>\n<p><span>Lendlease stated that it would \u201ccontinue to engage with the UK government on these industry-wide actions and assess additional relevant information on an ongoing basis\u201d.<\/span><\/p>\n<\/p><\/div>\n<h3>Related articles<\/h3>\n<\/p><\/div>\n<p><a href=\"https:\/\/www.constructionnews.co.uk\/contractors\/lendlease\/lendlease-seeks-to-claw-back-114m-safety-provision-14-02-2023\/\" class=\"button purchase\" rel=\"nofollow noopener\" target=\"_blank\">Read More<\/a><br \/>\n Ben Vogel<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Lendlease aims to \u201cmaximise third-party recoveries\u201d from subcontractors after the firm booked a provision in line with the latest housing-safety remediation requirements from the UK government.
