[Updated by author 1\/16 11 pm ET] Back in October, I spoke to experts who predicted<\/a> that legal battles over AI art and copyright infringement could drag on for years, potentially even going as far as the Supreme Court. <\/p>\n
Those battles officially began this past Friday, as the first class-action copyright infringement lawsuit around AI art was filed<\/a> against two companies focused on open-source generative AI art \u2014 Stability AI (which developed Stable Diffusion) and Midjourney \u2014 as well as DeviantArt, an online art community. <\/p>\n
Artists claim AI models produce \u201cderivative works\u201d <\/h2>\n
Three artists launched the lawsuit through the Joseph Saveri Law Firm<\/a> and lawyer and designer\/programmer Matthew Butterick, who recently teamed up to file a similar lawsuit<\/a> against Microsoft, GitHub and OpenAI, related to the generative AI programming model CoPilot. The artists claim that Stable Diffusion and Midjourney scraped the Internet to copy billions of works without permission, including theirs, which then are used to produce \u201cderivative works.\u201d <\/p>\n
In a blog post<\/a>, Butterick described Stable Diffusion as a \u201cpar\u00ada\u00adsite that, if allowed to pro\u00adlif\u00ader\u00adate, will cause irrepara\u00adble harm to artists, now and in the future.\u201d <\/p>\n

Stability AI CEO Emad Mostaque told VentureBeat that the company \u2014 which last month said<\/a> it would honor artist request to opt-out of future Stable Diffusion training \u2014 has \u201cnot received anything to date\u201d regarding the lawsuit and \u201conce we do we can review it.\u201d <\/p>\n
OpenAI\u2019s Sam Altman and DeepMind\u2019s Demis Hassabis signal caution<\/h2>\n
I\u2019ll be following up on this lawsuit with a more detailed piece \u2014 but thought it was interesting that the news arrives as both OpenAI (who released DALL-E 2 and ChatGPT to immense hype) and DeepMind (which has stayed away from publicly releasing creative AI models) expressed caution regarding the future of generative AI. <\/p>\n
In a Time magazine interview<\/a> last week, DeepMind CEO Hassabis said \u201cWhen it comes to very powerful technologies\u2014and obviously AI is going to be one of the most powerful ever\u2014we need to be careful,\u201d he says. \u201cNot everybody is thinking about those things. It\u2019s like experimentalists, many of whom don\u2019t realize they\u2019re holding dangerous material.\u201d In urging his competitors to proceed cautiously, he said \u201cI would advocate\u00a0not\u00a0<\/em>moving fast and breaking things.\u201d <\/p>\n
Meanwhile, as recently as a year ago, OpenAI CEO Sam Altman encouraged speed, tweeting<\/a> \u201cMove faster. Slowness anywhere justifies slowness everywhere.\u201d But last week he sang a different tune, according to Reuters reporter Krystal Hu, who tweeted<\/a>: \u201c@sama said OpenAI\u2019s GPT-4 will launch only when they can do it safely & responsibly. \u2018In general we are going to release technology much more slowly than people would like. We\u2019re going to sit on it for much longer\u2026’\u201d <\/p>\n
[Update: Of course, that doesn\u2019t mean OpenAI is really slowing down. Tonight, in fact, the company announced<\/a> that \u201cwe\u2019ve learned a lot from the ChatGPT research preview\u201d and that ChatGPT will also be coming to its API soon.]<\/p>\n

Generative AI can turn \u201cfrom foe to friend\u201d <\/h2>\n
Debates around generative AI \u2014 whether in lawsuits, magazine articles or tweets \u2014 are certainly only beginning. But the time for these conversations is now, according to the World Economic Forum, which released an article yesterday on the topic tied to its annual meeting currently happening in Davos, Switzerland. <\/p>\n
\u201cJust as many have advocated for the importance of\u00a0 diverse data and engineers in the AI industry<\/a>, so must we bring in expertise from psychology, government, cybersecurity and business to the AI conversation,\u201d the article said. \u201cIt will take open discussion and shared perspectives between cybersecurity leaders, AI developers, practitioners, business leaders, elected officials and citizens to determine a plan for thoughtful regulation of generative AI. All voices must be heard. Together, we can surely tackle this threat to public safety, critical infrastructure and our world. We can turn generative AI from foe to friend.\u201d <\/p>\n
