According to <a href=\"https:\/\/thedcline.org\/2022\/12\/30\/press-release-ag-racine-secures-3-5-million-from-grubhub-for-illegally-charging-hidden-fees-using-deceptive-marketing-tactics-to-boost-profits-at-expense-of-customers\/\">a press release<\/a>, Grubhub must pay $800,000 to DC as a civil penalty, while the remaining $2.7 million \u201cwill be paid back to affected customers.\u201d<\/p>\n<p>In March, <a href=\"http:\/\/www.theverge.com\/2022\/3\/21\/22989563\/district-of-columbia-karl-racine-grubhub-lawsuit-misleading-fees\">DC Attorney General Karl Racine filed a lawsuit against Grubhub<\/a>, accusing it of falsely promising \u201cfree\u201d online orders to customers, as well as \u201cunlimited free delivery\u201d for those who subscribe to Grubhub Plus. The lawsuit alleges this practice is \u201cdeceptive\u201d since Grubhub still takes a service fee for non-pickup orders made by Grubhub Plus customers, and charges both delivery and service fees for standard orders as well.<\/p>\n<p>It also cites several other questionable business practices, such as the way Grubhub bundled service fees in a single line with sales taxes on the checkout page, something the company only stopped doing recently. Grubhub was previously <a href=\"http:\/\/www.theverge.com\/2020\/1\/29\/21113876\/grubhub-seamless-fake-restaurant-listings-no-permission-postmates-doordash\">accused of listing restaurants on the platform<\/a> without their permission to expand the service, and <a href=\"http:\/\/www.theverge.com\/2019\/6\/28\/19154220\/grubhub-seamless-fake-restaurant-domain-names-commission-fees\">launched a series of microsites<\/a> resembling restaurants\u2019 real sites in order to route orders through Grubhub. At the time of the suit\u2019s filing, <a href=\"https:\/\/twitter.com\/dwtovar\/status\/1505930332096372739?s=20&#038;t=V7hYVyInwExqetPSb5HzpQ\">Grubhub refuted the claims<\/a> and said \u201cmany of the practices at issue have been discontinued.\u201d <\/p>\n<p>\u201cSettling this lawsuit is in the best interest of our business and the matter is now resolved,\u201d Grubhub spokesperson Liza Dee says in a statement to <em>The Verge<\/em>. \u201cGrubhub is committed to supporting all restaurants and diners, and is taking a number of steps to ensure price transparency.\u201d<\/p>\n<p>As part of the settlement, Grubhub\u2019s required to \u201cplace a refundable credit\u201d in the accounts of affected customers, which applies to anyone who has \u201cpaid a small order or service fee on an order placed via the Grubhub Platform\u201d at a restaurant located in DC anytime between January 1st, 2016 to December 31st, 2022. Affected customers will get split into three groups depending on how often they used the platform, with those in the first group getting at least $4.50, the next getting at least $7, and the people in the final group getting at least $10. If the account owner doesn\u2019t redeem the credit within 90 days of receipt, Grubhub\u2019s required to send them a check with the amount they\u2019re owed.<\/p>\n<div>\n<p>\u201cGrubhub\u2019s hidden fees and misleading marketing tactics were designed to get the company an extra buck\u201d<\/p>\n<\/div>\n<p>In addition to the payment, the platform\u2019s required to make a number of changes, such as prominently displaying any additional fees to customers at checkout, listing each fee on separate lines, and shutting down or transferring ownership of the microsites it made for restaurants located in DC. Grubhub must also stop telling Grubhub Plus members that they can receive \u201cfree delivery,\u201d and now has to disclose when the prices for certain menu items are higher than what they\u2019re advertised at restaurants themselves.
