Dutch Gaming Authority fines popular streamer Nedergaming for promoting illegal casino streams

The Dutch Gambling Authority has penalized the Dutch gaming streamer Nedergaming for promoting the unlicensed online casino HolyLuck through various social media platforms like YouTube, Twitch, and Kick.

The gambling regulator mentioned that the streamer had advertised the illegal site several times during live streaming sessions and also during the upload of pre-recorded videos. Subsequent checks revealed that Dutch players had no issues at all with registering, depositing, and playing casino games on HolyLuck.

By streaming the entire gameplay, the monitor repeatedly displayed the non-licensed site, and the casino’s name was shown to the viewers in a very prominent way. At times, even an Excel sheet with the operator’s name was visible. The Gaming Authority determined that the defendant’s behavior amounts to the promotion of illegal gambling, which is an offense punishable under Dutch law.

The regulator’s commission explained that the absence of direct affiliate links, bonus codes, or explicit invitations to join the platform does not mean however that the law has not been violated. Conducting a public live stream of gameplay with an unlicensed provider can still have a strong motivating effect on the audience and make them feel that participating is a normal thing.

Streamer Claims International Audience

Nedergaming warranted his point by indicating that the streams were based on a global audience, and the language of the streams was English only. However, The Gaming Authority has completely rejected this excuse, pointing out that it is possible to use the English language while still targeting the Dutch audience.

In addition, the majority of the Dutch people are quite fluent in English and the streamer was introducing at times the things that are familiar to the local audience in his streams like the supermarket chain Albert Heijn and “witches cheese, ” a popular local product. The regulator pointed out that the content does not have to be exclusively aimed at the Netherlands. Even a partial targeting of the Dutch people can lead to enforcement.

Furthermore, the Gaming Authority has cautioned the gambling streamers as a whole that they are going to take extremely strong actions if they keep endorsing unlicensed operators. On 2nd February 2025 the officials held a Microsoft Teams meeting with Nedergaming during which they, without doubt, laid out rules against the advertisement of illegal gambling activities.

Immediate Actions and Penalty Details

Nedergaming has just received a notice from the Gaming Authority instructing the operator to immediately stop the advertising of unlicensed online casinos. He must also remove all the videos or streams that display these gambling operators within five working days.

The penalty of 25,000 euros is imposed for each violation found and can be increased to 75,000 euros. Apart from that, if the illegal material is not taken down, additional penalties will be levied.

For the moment, the videos in question have been removed from the platforms. When contacted by CasinoNieuws.nl, Nedergaming did not comment. The article will be updated once a response is received.

In February, another streamer by the name of Rouand YT2 has also been given a similar sentence for promoting illegal gambling websites, including HolyLuck.
